The terms, in plain words

This is the agreement between you and EverBanyan when you build or keep a memorial here. It is written to be read, not skimmed past. If anything in it is unclear, write to us — a person answers.

What EverBanyan is

EverBanyan is a living tree memorial for a pet. You build it in private, for free, with no account. If you choose to keep it, the memorial becomes yours: a page at a private link, a 4K portrait, a printable QR visiting card, and a complete offline copy.

Keeping is one purchase, owned forever

• A kept memorial is a one-time purchase, owned forever. There is no subscription on a memorial, and it is never deleted or degraded because you didn’t pay again. Nothing you have kept is ever taken away, except by refunding that exact thing.
• The first hundred kept memorials are free. A free keep is the full purchase in every respect except money — the same page, the same files, the same permanence. It is not a lesser class, now or ever.
• One keep per memorial — the same “bought once” rule whether it was free or paid.
• Your files stay with us for at least three years from delivery. The status page we email you can fetch the 4K portrait, the visiting card and the offline archive again whenever you need them in that time. They are also yours to keep — save your own copies too.
• Anything else we offer later (photo leaves, palettes, weather) is an optional one-time addition on top of a memorial that is already complete without it. Until payments open, those additions simply aren’t for sale.

Your words stay yours

The name, the dates, the dedication, the memories, the photo — they are yours. By keeping a memorial you give us just enough permission to do our job: to show your memorial at its link, to make your files, and to hold backups so it survives our mistakes. We never sell it, never hand it to advertisers, and never use it for anything except being your memorial. (The details of what we store and how are on the privacy page.)

The offline copy is the deepest promise

Every kept memorial comes with a self-contained offline archive. It works with no internet and no EverBanyan — your memorial survives even if this company someday does not. We built it that way on purpose, so that permanence is something you hold, not something you have to keep trusting us for.

What we ask of you

• A memorial holds only what belongs in one. Photos are looked at by a person before they appear anywhere, and we may decline one that is unlawful, hateful, or plainly isn’t yours to share. We will always tell you if we decline.
• Build memorials for companions you have the right to remember — your own words, your own photos.
• Don’t attack, overload, or try to break the service. Reading it is welcome — people, search engines, and AI assistants alike.

Your link, your choice

A memorial lives at a private link that can’t be guessed. Who sees it is decided by who you hand the link to. It stays out of search engines unless you explicitly choose otherwise.

Changing your mind

You can keep adding memories to a kept memorial. To correct something, move a memorial, or delete it — or every trace of you — write to hello@everbanyan.com and a person will do it with you. A free keep moved no money, so there is nothing to refund — but the order is recorded, and any reversal is done properly against that record. Before the first paid order is ever taken, a plain refund policy will be added here, dated.

What we promise about the service itself

EverBanyan is a small, carefully run service — one server, tended by hand, backed up regularly. We work to keep it up and honest, and when something breaks we say so and fix it. We don’t promise perfection; we promise care, and we gave you the offline copy precisely so that our worst day can never take your memorial with it.

The housekeeping

You must be old enough to enter this agreement where you live. This agreement is governed by the laws of India. If we change these terms, the change and its date appear right here — quietly, like everything else.
